The Temporary Partner (Provisional) Visa (subclass 309) is issued first, which allows you to stay in Australia until the Permanent Partner (Migrant) Visa (subclass 100) is processed.

Are You Eligible?

You must be married or have a de facto relationship with:

  • A Permanent Australian Citizen.
  • Eligible Citizen of New Zealand.
  • Under Australian law, the marriage has to be legal. This means that if you are 16 or 17 years old, you must have parental authorization.
  • In at least 12 months, you ought to have been in a de facto relationship.
  • Unless you were in a long-term relationship or if your spouse had a similar visa before applying, you may be given a permanent visa within less than two years.

Length of Stay

You will remain on the temporary 309 visa until the permanent Partner Visa (subclass 100) is determined. You will live permanently on a permanent 100 visa.
